Terms of Service

These terms are an agreement between you and Churp ("Churp", "we", "us"). By creating an account or using the Churp app, you accept them. If you don't agree, don't use Churp. You must be at least 18, or the age of legal majority where you live, to use Churp.

Churp is a macOS assistant that turns your voice into text and drafts replies using what's visible on your screen at the moment you trigger it. Drafts appear at your cursor for you to review — nothing is ever sent on your behalf.

We grant you a personal, non-exclusive, non-transferable license to install and use the Churp app for your own business or personal use while your subscription is active. You agree not to:

• ·Resell, sublicense, or share your account or the app.
• ·Copy, modify, reverse engineer, or create derivative works of the app.
• ·Probe, disrupt, or overload the service, or circumvent its limits or security.
• ·Use automated means to extract or scrape the service.

• ·Churp is a paid subscription with a 5-day free trial. A payment method is required to start the trial.
• ·Unless you cancel before the trial ends, your subscription begins automatically at the plan and price shown at checkout.
• ·Subscriptions renew automatically each billing period until cancelled.
• ·You can cancel any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
• ·Except where required by law, payments are non-refundable.
• ·Prices may change; we'll give you notice before a change affects your renewal.

Billing is processed by Stripe. Taxes may apply depending on your location.

You own your content — your voice, your screen, your profile, and the messages you send. You grant us a limited license to process that content solely to provide the service to you (for example, transcribing your audio and generating your drafts), as described in our Privacy Policy.

Churp uses macOS permissions you grant — microphone, screen recording, and accessibility — only to deliver its features. You're responsible for making sure you're allowed to use these capabilities on the device and accounts where you run Churp.

• ·Drafts are suggestions generated by AI. They can be wrong, incomplete, or miss context.
• ·You review every draft before it goes anywhere. The messages you send are yours — you're responsible for their accuracy and consequences.
• ·Churp doesn't guarantee sales outcomes, response rates, or the accuracy of any generated content.

You agree not to use Churp to:

• ·Break the law, or infringe anyone's rights.
• ·Send spam, scams, or deceptive or harassing messages.
• ·Violate the terms of the platforms you message on.
• ·Process data you don't have the right to process.

We may suspend or terminate accounts that violate these terms.

We work hard to keep Churp fast and reliable, but the service is provided "as is" and "as available." We may add, change, or remove features, and we may discontinue the service with reasonable notice.

To the fullest extent permitted by law: Churp disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Churp will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

You can stop using Churp and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these terms. Sections that by their nature should survive termination (including 5, 6, 9, and 11) survive.

These terms are governed by the laws of the United States and the state in which Churp's operator is organized, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at support@churp.ai and give us 30 days to work it out informally.

If we make material changes, we'll update this page and the date above. Continued use of Churp after a change means you accept the updated terms.
